Abuse of elderly people takes many forms and may not be physical at all. With the promulgation of the regulations to the Older Persons Act, we enter a new era in which the senior citizen at last has recourse to law and is able to obtain protection for him or herself. In fact the people themselves need not even be the prime movers in reporting abuse – when abuse is reported, the Minister must launch an investigation by law, so even whistle-blowers will in fact be able to cause action to be initiated.
Unhappily some of the abuse may actually take place in retirement homes, but this legislation will definitely assist in bringing offenders to book, even if they are in a registered institution.
The issue of elderly abuse is being addressed by SACSO (South African Confederation of Seniors Organisations), and one of its permanent subcommittees has been assigned to the task. SAARP will continue to monitor this situation and to maintain its role of go-between.
A number of issues in this regard have now been addressed by the newly promulgated Older Persons Act. (Act 13 of 2006) The regulations which provide enforcement impetus have however, as at this date, not yet been promulgated. We have a very important piece of legislation which is in fact a “principle Act” in the same vein as our Constitution – ie. it subordinates other existing legislation into conforming to the intention of this Act. (This is why people can appeal to the Constitutional Court on matters of law and a ruling may be given that holds a particular law to be contrary to the Constitution and therefore invalid.)
